一、比荷卢商标概要
比荷卢联盟商标法于1963年4月25日、1968年8月19日和1969年6月30日分别被荷兰政府、卢森堡政府和比利时政府批准，1971年1月1日正式生效，取代了原来各内国的商标法规；1983年11月10日修改商标法，1987年1月1日生效；1989年7月1日生效的行政法规；1989年7月1日生效的实施细则。为了适应欧共体协调法令，比荷卢联盟修改了商标法并于1996年1月1日生效。统一后的商标法的基础上，一份注册申请效力即可覆盖整个三个国家。比荷卢商标注册权的取得基于申请在先原则，接受商品商标、服务商标、系列商标、联合商标和集体商标的注册申请，采用商标注册用商品和服务国际分类。比利时、卢森堡、荷兰是《保护工业产权巴黎公约》、《商标国际注册马德里协定书》、《与商标国际注册马德里协定有关的议定书》、《商标注册用商品和服务国际分类尼斯协定》和世界知识产权组织成员国。
二、比荷卢商标审查
收到商标注册申请后，官方首先进行形式审查并将申请予以公告，同时进入实质审查阶段。任何第三方都可以在2个月的公告期内对该商标申请提出异议。审查员也同时对该商标的可注册性进行审查。商标申请没有被官方予以驳回或没有第三方的异议将被核准注册并颁发注册证书。
商标注册有效期为自申请日起10年，续展有效期也是10年。商标所有人可以自有效期届满6个月前提出续展申请。对注册商标连续不使用5年将有可能导致商标撤销。

1.Summarization of Bihelu trademark
The trademark law of the Union of Belgium was approved by the Government of the Netherlands, the Government of Luxembourg and the Government of Belgium on April 25, 1963, August 19, 1968 and June 30, 1969, respectively. It entered into force on January 1, 1971, replacing the original domestic trademark laws and regulations. The Trademark Law was amended on 10 November 1983 and entered into force on 1 January 1987 ; administrative regulations in force on 1 July 1989 ; rules of Implementation effective 1 July 1989. In order to adapt to the EC coordination decree, the BiHollu Union revised the trademark law and entered into force on January 1, 1996. Based on the unified trademark law, a registration application can cover the whole three countries. Based on the principle of application first, the acquisition of trademark registration right in Bihelu accepts the application for registration of commodity trademarks, service trademarks, series trademarks, joint trademarks and collective trademarks, and adopts the international classification of goods and services for trademark registration. Belgium, Luxembourg and the Netherlands are members of the Paris Convention for the Protection of Industrial Property, the Madrid Agreement on International Registration of Trademarks, the Protocols relating to the Madrid Agreement on International Registration of Trademarks, the Niss Agreement on the International Classification of Goods and Services for Trademark Registration and the World Intellectual Property Organization.
2.Behelu trademark review
Upon receipt of an application for trademark registration, the official first conducts a formal review and announces the application, while entering the substantive review stage. Any third party can challenge the trademark application within 2 months. Inspectors also review the trademark registration. Trademark application is not rejected by the official or there is no third party objection will be approved registration and issued registration certificate.
The trademark registration period is 10 years from the date of application, and the renewal period is 10 years. The trademark owner may apply for renewal 6 months before the expiry of the term. The non-use of registered trademarks for five consecutive years could lead to the revocation of trademarks.
