关于注册比荷卢商标的概要与法律规定

  比荷卢商标概要:


  1、比利时、荷兰、卢森堡经济联盟(简称比荷卢联盟)新商标法于1996年1月1日生效。新商标法是为了与欧洲经济共同体协调法律保持一致而对原法令进行的修改。商标法修改要点:取消了3年使用的规定(原法要求商标自申请之日起3年内必须在比荷卢联盟三国中任一国家进行使用);因商标未使用而失效的如果在5年后重新使用的可以恢复商标注册效力;商标许可使用合同不以签订书面合同为必要,被许可使用人的使用视为商标许可人的使用。

  2、比荷卢联盟商标注册权的获得基于申请在先原则。

  3、比荷卢联盟商标局接受商品商标、服务商标、系列商标、联合商标、集体商标、色彩商标的注册申请。

  4、比荷卢联盟商标注册采用商标注册用商品和服务国际分类。

  一份商标申请可以指多个类别的商品或服务。商品或服务超过三个类别时,每增加一类加收费用。

  5、比利时、卢森堡、荷兰为《保护工业产权巴黎公约》(斯德哥尔摩版本)、《商标国际注册马德里协定书》和《与商标国际注册马德里协定有关的议定书》、《商标注册用商品和服务国际分类尼斯协定》及世界知识产权组织成员国,其中比利时于1892年7月15日加入马德里协定书,1998年4月1日加入马德里议定书,荷兰于1893年3月1日加入马德里协定书,1998年4月1日加入马德里议定书,卢森堡于1924年9月1日加入马德里协定书,1998年4月1日加入马德里议定书,属同为协定同为议定成员国。


  比荷卢商标的法律规定:

  比荷卢联盟商标法于1963年4月25日、1968年8月19日和1969年6月30日分别被荷兰政府、卢森堡政府和比利时政府批准,1971年1月1日正式生效(68 Pat.&T.M.M.Rev.156),取代了原来各内国的商标法规;1983年11月10日修改商标法(68 Pat.&T.M . Rev.160),1987年1月1日生效;1989年7月1日生效的行政法规;1989年7月1日生效的实施细则。为了适应欧共体协调法令,

  比荷卢联盟修改了商标法并于1996年1月1日生效。

  统一后的商标法为统一的比荷卢联盟商标注册铺平了道路。一份注册申请效力即可覆盖整个三个国家。


  过渡性条款:

  自1986年商标法生效以来,比荷卢联盟商标局开始接受服务商标注册申请。自1987年1月1日起,即自引人服务商标的议定书生效日开始,在比荷卢联盟地区使用服务商标的申请人可以自该生效日起一年内任意时间申请该服务商标注册,注册日均从1987年1月1日起算,以示享有优先权。任何人不得以其商标注册早于在后相似商标为惟一理由而主张该在后服务商标注册无效。基于1987年1月1日以前在比荷卢联盟地区的使用而产生的服务商标权不受1983年11月10日生效的议定书的规定的影响。


  该三国是作为一个体系,注册时是按一个国家计算费用。

1. The new trademark law of the Economic Union of Belgium, the Netherlands and Luxembourg ( hereinafter the Union of Belgium ) entered into force on 1 January 1996. The new trademark law is a revision of the original law to maintain consistency with the European Economic Community coordination law. Points for amendments to the trademark law : cancellation of the three-year use requirement ( the original law requires that the trademark be used in any of the three countries of the Union of Belgium within three years from the date of application ) ; failure due to non-use of the trademark can restore the effectiveness of the trademark registration if re-used after five years ; a trademark license contract is not necessary to sign a written contract, and the use of the licensee is regarded as the use of the trademark licensee.

2. The acquisition of trademark registration right is based on the principle of prior application.

3. The BHP Trademark Office accepts the application for registration of commodity trademarks, service trademarks, series trademarks, joint trademarks, collective trademarks and color trademarks.

4. The international classification of goods and services for trademark registration is adopted in the trademark registration of the BHP.

A trademark application may refer to multiple categories of goods or services. When goods or services exceed three categories, each additional category is charged.

5. Belgium, Luxembourg, the Netherlands for ' Paris Convention on the Protection of Industrial Property ' ( Stockholm version ), ' Madrid Agreement on International Registration of Trademarks ' and ' Protocols related to the Madrid Agreement on International Registration of Trademarks ', ' Niss Agreement on International Classification of Goods and Services for Trademark Registration ' and Member States of the World Intellectual Property Organization, Belgium acceded to the Madrid Agreement on 15 July 1892, the Madrid Protocol on 1 April 1998, the Netherlands acceded to the Madrid Agreement on 1 March 1893, the Madrid Protocol on 1 April 1998. Luxembourg acceded to the Madrid Protocol on 1 September 1924 and to the Madrid Protocol on 1 April 1998.

 

Bihelu trademark law :

On April 25, 1963, August 19, 1968 and June 30, 1969, the Trademark Law of the Union of Belgium was approved by the Government of the Netherlands, the Government of Luxembourg and the Government of Belgium, respectively. On January 1, 1971, the Trademark Law of the Union of Belgium entered into force ( 68 Pat. & T.M.M.Rev.156 ), replacing the original domestic trademark regulations ; amendment of the Trademark Law on 10 November 1983 ( 68 Pat. & T.M. Rev.160 ), effective 1 January 1987 ; administrative regulations in force on 1 July 1989 ; rules of Implementation effective 1 July 1989. To adapt to the EC Coordinating Act.

The BiHollu Union revised the trademark law and entered into force on January 1, 1996.

The unified trademark law paves the way for the unified trademark registration of the BHP. A registration application can cover the entire three countries.

 

Transitional provisions :

Since the entry into force of the Trademark Law in 1986, the Trademark Office of the BHP began to accept the application for registration of service trademarks. Since January 1, 1987, that is, from the date of entry into force of the Protocol on the Invocation of Service Trademarks, the applicants who use the service trademark in the BHP area can apply for the registration of the service trademark at any time within one year from the date of entry into force. The average registration date is calculated from January 1, 1987, in order to show priority. No person shall claim that the post-service trademark registration is invalid on the sole ground that its trademark registration is earlier than the post-similar trademark. The right to a service trademark arising from the use in the Area of the Union of BiH prior to 1 January 1987 is not affected by the provisions of the Protocol entered into force on 10 November 1983.

 

The three countries are regarded as a system, and the fees are calculated according to one country when they are registered.
