冰岛商标注册相关知识介绍

       冰岛商标注册可以通过单一国家注册申请或是马德里商标注册的途径申请,不过需要注意的一点是冰岛不是欧盟成员国,不能通过欧盟商标注册的方式来获取冰岛商标。下面我们来看下冰岛商标注册的一些详细内容:

  申请人可以通过两种途径在冰岛申请商标注册:一是委托冰岛当地的代理机构直接向冰岛专利局递交申请;二是可通过世界知识产权组织国际局申请马德里国际注册以指定冰岛来获得注册保护(即马德里国际注册)。在冰岛注册商标,从提出申请到取得专用权的时间一般约为3至5个月;注册商标的有效期为10年,此后每10年为一期续展注册。


冰岛在商标领域与我国商标法律规定不同的,有以下几个方面:一是对商标合法使用的定义不同。如果商标在使用时与注册商标略有不同,但这种不同并不影响商标的显著性,或商标专用在冰岛出口商品的包装上,都视为商标的合法使用;如商标经商标权利人同意的使用,也被视为是所有者的有效使用。应商标所有人的要求,可以对商标作出不影响商标整体印象的细微变更,变更须在冰岛专利局进行备案,并在《专利公报》予以公告(我国《商标法》规定,只要变更了注册商标图样,必须重新申请)。二是法律规定任何想转让商业活动的人必须连同其商标一起转止,除非有其他的协议。三是自商标注册日起5年内或在任意一个连续5年内,未在指定的商品或服务上使用注册商标的,存在被撤销注册商标的风险。

Applicants can apply for trademark registration in Iceland through two ways : one is to entrust the local agency of Iceland to submit the application directly to the Icelandic Patent Office ; second, through the World Intellectual Property Organization International Bureau to apply for Madrid international registration to designate Iceland to obtain registration protection ( Madrid international registration ). In the case of registered trademarks in Iceland, the time from filing an application to obtaining exclusive rights is generally about 3 to 5 months. The validity period of the registered trademark is 10 years, and thereafter every 10 years is a renewal registration.


Iceland is different from our trademark law in the field of trademark, there are the following aspects : First, the definition of trademark legal use is different. If the trademark is slightly different from the registered trademark in use, but this difference does not affect the visibility of the trademark, or the trademark is exclusively used in the packaging of Icelandic export commodities, it is regarded as the legitimate use of the trademark. If the trademark is used with the consent of the trademark holder, it is also regarded as the effective use of the owner. At the request of the trademark owner, the trademark can be made a slight change without affecting the overall impression of the trademark. The change must be recorded in the Icelandic Patent Office and announced in the ' Patent Bulletin ' ( China ' s ' Trademark Law ' stipulates that as long as the registered trademark pattern is changed, it must be reapplied ). Second, the law stipulates that any person who wishes to transfer commercial activities must revoke with his trademark unless there are other agreements. Third, if the registered trademark is not used in the specified goods or services within 5 years from the date of trademark registration or in any continuous 5 years, there is a risk of revocation of the registered trademark.
