波兰商标注册所需资格材料和审查流程

一、波兰商标注册简介

 

1、1994年EAA协议在波兰和欧盟之间生效。这使包装商标的注册更加简便,包括包装装饰以及商品外形的装饰。欧盟委员会的限制指示规定,基于商品性质的包装商标不予注册,取得技术效果和/或产品附加值的外形也不予以注册。新的协议还规定,商标的地区耗尽原则可以向欧盟提出诉讼。


值得注意的是,波兰在1994年11月29日拒绝加入欧盟组织。

波兰国会于1995年12月22日通过了波兰商标法的修订案。这次修订包括:申请可以不用事先公告就在商品局取得注册,对于放弃申请的再陈述请求的时限缩短到2个月,不再接受在国际分类系统中申请各类别标题的申请,申请指定商品和服务必须在相关国际分类中列举出来。

2、波兰的商标法和集体商标法制定于1961年3月。

3、在波兰,商标权的取得基于注册原则。

4、在波兰,商品商标、服务商标和集体商标可以申请注册。

5、目前,波兰是国际《保护工业产权巴黎公约》、《商标注册用商品和服务国际分类尼斯协定》和世界知识产权组织的成员国。

二、商标注册流程及所需详细资料

1、波兰商标查询

查询波兰官方的商标手册以排除拟注册商标与在先权利商标因相同或相似而被驳回的可能性。

2、波兰商标申请

向波兰专利局提出商标注册的受理和审查申请。

3、商标注册说明:

属于《马德里商标国际注册》成员国;加入的其他国际公约和国际组织:《保护工业产权巴黎公约》,《商品和服务国际分类尼斯协定》,世界知识产权组织,欧洲联盟;

4、商标注册所需时间:12-15个月;商标注册有效期:10年,自提交商标申请日起;可注册商标种类:商品商标,服务商标,集体商标;

注册商标续展:可在商标注册期满前1年内,或注册到期后6个月宽展期内提出申请,续展有效期为10年;注册商标连续不使用撤销时间:3年。

5、申请人主体资格:任何从事商业活动的人都可以申请注册商标并且获得商标专用权。但是在波兰不进行商业活动的人申请注册商标时,应当出具其拥有该注册商标的证明。证明中显示的商标应当与在波兰申请注册商标一致,并且在波兰取得的注册所享有的保护范围将不大于其原属国的注册。

6、申请所需文件:

(1)商标图样。

(2)经申请人签署的委托书。

(3)本国注册复印件,无需认证。

7、审查流程:专利局将就申请文件的形式、商标的可注册性以及是否有在先的相同或近似注册或申请进行审查。申请当局若发现申请文件又缺陷,将通知申请人限期改正,若在期限内不作答复,申请人将被视为自动放弃申请。但是,在期限期满后的4个月内,申请人若补交一笔费用,其申请将被重新考虑。经修改后的申请还不能符合法定要求的,审查当局将予以驳回。

1. Brief introduction to Polish trademark registration

 

1. The 1994 EAA Agreement entered into force between Poland and the EU. This makes the registration of packaging trademarks easier, including packaging decoration and decoration of the shape of the goods. The European Commission ’ s restrictive instructions stipulate that packaging trademarks based on the nature of commodities are not registered, and the shape of the technical effect and / or product added value are not registered. The new agreement also provides that the principle of exhaustion of trademarks may be brought before the EU.

 

It is noteworthy that Poland refused to join the EU on 29 November 1994.

Polish Congress passed the amendment of Polish Trademark Law on December 22, 1995. This revision includes : the application can be registered in the Bureau of Commodities without prior notice, the time limit for re-statement request to abandon the application is shortened to 2 months, and the application for various categories of titles in the international classification system is no longer accepted. The application for designated goods and services must be listed in the relevant international classification.

2. Polish Trademark Law and Collective Trademark Law were enacted in March 1961.

3. In Poland, the acquisition of trademark rights is based on the principle of registration.

2. Trademark registration process and details required

1. Polish Trademark Inquiry

Check the Polish official trademark manual to exclude the possibility that the proposed registered trademark and prior rights trademark are rejected for the same or similar reasons.

2. Polish trademark application

The application for acceptance and review of trademark registration is submitted to Polish Patent Office.

3. Description of trademark registration :

Belong to ' Madrid trademark international registration ' member countries ; other international conventions and international organizations to which they are parties : ' Paris Convention for the Protection of Industrial Property Rights ', ' Ness Agreement on the International Classification of Goods and Services ', World Intellectual Property Organization, European Union ;

4. Time required for trademark registration : 12 – 15 months ; trademark registration validity : 10 years, from the date of submission of trademark application ; registerable trademark types : commodity trademark, service trademark, collective trademark ;

renewal of registered trademarks : applications can be filed within one year before the expiry of the trademark registration period, or within the six-month extension period after the expiry of the registration period, and the renewal period is 10 years ; the cancellation time of registered trademark is 3 years.

5.       The applicant ' s subject qualification : Anyone engaged in commercial activities can apply for a registered trademark and obtain the exclusive right of trademark. However, when a person who does not engage in commercial activities in Poland applies for a registered trademark, he or she shall issue a certificate that he or she has the registered trademark. The trademark shown in the proof should be consistent with the application for registered trademark in Poland, and the scope of protection for registration in Poland will not be greater than that for registration in its country of origin.

6. Documents required for application :

( 1 ) Trademark pattern.

( 2 ) An application signed by the applicant.

( 3 ) Copy of domestic registration, without certification.

7. Review process : The Patent Office will review the form of application documents, the registrability of trademarks and whether there is prior identical or similar registration or application. If the application authority finds that the application document is defective, it will notify the applicant to correct it within a time limit. If the applicant does not respond within the time limit, it will be regarded as automatically abandoning the application. However, within four months of the expiration of the period, the applicant 's application will be reconsidered if a fee is paid. If the amended application fails to meet the statutory requirements, the review authority will reject it.
