如何办理波兰商标注册？

一、波兰商标注册概述

波兰现行商标法规主要基于2001年8月22日生效的《工业产权法》。“波兰专利局”负责统一管理商标事务,官方语言为波兰语。波兰商标注册采用“申请在先”原则。

波兰是《内罗毕条约》、《巴黎公约》、《WIPO公约》、《知识产权协定》、《商标法条约》等国际知识产权条约的缔约国，也是《马德里协定》、《马德里议定书》的成员国,还是欧盟成员国,故波兰商标注册可以通过“单一国家注册”、“马德里国际注册”、“欧盟商标注册”等方式办理。

二、波兰商标注册要求

波兰可注册为商标的要素有：文字、字母、数字、图形、标语、颜色、颜色组合、立体形状等。在波兰没有住所或主要营业场所或真实、有效的工商企业的自然人或法人,须委托本国专门的商标代理机构办理波兰商标注册。

三、波兰商标注册所需材料

1.商标图样;

2.商标类别及商品名称;

3.申请人姓名及地址;

4.委托书;

5.若声明优先权的，需提供优先权证明文件。

四、波兰商标注册流程

波兰商标注册的主要流程为:提交—审查—公告—注册。

五、波兰商标有效期

波兰商标注册后10年有效,有效期自申请日起算，到期前6个月内可以办理续展，续展后有效期仍为10年。

2. Polish trademark registration requirements

Poland can be registered as trademark elements : text, letters, numbers, graphics, slogans, colors, color combinations, three-dimensional shapes, etc. A natural or legal person who does not have a residence or major place of business or a genuine and effective business enterprise in Poland shall entrust a specialized national trademark agency with the registration of Polish trademarks.

4. Polish trademark registration process

The main process of Polish trademark registration is : submission-review-announcement-registration.

5.Validity period of Polish trademark

The Polish trademark is valid 10 years after registration, and the validity period is calculated from the application date. It can be continued within 6 months before the expiration, and the validity period is still 10 years.
